TERMS AND CONDITIONS
We advise all our customers to carefully read our Terms and Conditions before placing any order or signing up to our website to avoid any inconvenience for either side.
INTRODUCTION
These terms and conditions shall govern how you use our website.
By using our website, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, you must not use our website.
If you register with our website or use any of our website services, we will ask you to expressly agree to these terms and conditions.
You must be over 18 years of age to use our website; and by using our website or agreeing to these terms and conditions, you warrant and represent to us that you are at least 18 years of age.
Our website uses cookies; by using our website or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our (privacy and cookies policy).

You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. We can only process orders that are delivered to the card holders address. If the card issuer refuses to or does not, for any reason, authorise the payment, we will not be liable for any delay or non-delivery.
DELIVERY
We offer FREE DELIVERY on any order over £30. For orders less than £30 we would charge £4.99 for delivery.
With Standard Delivery/Free Delivery the delivery time is stated on the product information page. Delivery usually takes 2-7 working days to arrive. For large items such as garden furniture we or our delivery partners will call you to arrange a delivery date of your choosing. Delivery is kerbside only. If you require 2 man delivery service please contact us for further details.
If we attempt to make a delivery on the delivery date/timeslot that you have accepted and no one is present to receive the goods, necessitating a repeat delivery, you will incur a repeat delivery charge of £50, which must be paid prior to the redelivery even if the original delivery was free of charge. This repeat delivery charge will also apply if you cancel an agreed delivery date/timeslot less than two working days prior to the agreed date
Orders are normally despatch within 24 hours of receiving your order, Monday to Friday(unless otherwise stated). If your order is placed on the weekend, your order will be sent on the Monday.
If a product requires a longer despatch or delivery time, we will state this on the product page.
DELIVERY ACCESS
The customer will be responsible for providing our delivery partners with access to the address as necessary for the delivery. You must also ensure that access is available for a large lorry. Please contact us if a small vehicle is required to make the delivery. Please also inform us of any road inaccessible to delivery vehicle, parking permits required for successful delivery.
Where there is any doubt we suggest you conduct a site survey prior to placing your order and make Harts aware of any issues so we can discuss best
SHORT DELIVERY, DEFECTIVE OR DAMAGED GOODS
We strongly advise you to thoroughly check your goods upon receipt. To protect your interests, any claim concerning short delivery and/or damaged and/or defective goods found on delivery, or concerning damaged or defective goods found at a later date, must be notified within 24 hours to our customer services or via email. We do not accept any claims for damage caused by you the customer.
CANCELLATION AND RETURNS PROCEDURE
You are entitled to cancel this contract if you wish to do so, provided you exercise your right no longer than 7 working days after the day on which you receive your delivery. To exercise your right of cancellation you must give written notice to Harts Furniture via letter or email with full details of your order. Notification by telephone is not sufficient.
If you wish to cancel this contract once your order has been dispatched please note the following procedure will apply:
Should you wish to return a furniture item we will arrange to collect this item from you and will apply an appropriate collection charge.
The collection charge will be the same cost as the original delivery charge levied and will be deducted from the refund value when processed.
If the original delivery charge was free then a charge of £50 for the collection will be charged.

Harts Furniture reserve the right to refuse a refund on the item, and commercial cancellations will a 30% re-stocking charge may be applied.
You will be reimbursed to the card with which you paid for the goods once the goods have been received back into our Distribution Centre. Please note that your original delivery charges will not be refunded. A refund of the delivery charge will only be given in the instance of incorrect, damaged or faulty goods. It would be the customers responsibility to ensure the furniture is packaged well for transport. We would recommend customers keeping any important packaging such as the large boxes.
We have a number of payment methods available on our website. If you pay via Klarna or Clearpay and require a refund, there will be 5% deducted from the refund. This is to cover their non-refundable fees.
REFUSAL OF REFUND
Harts Furniture reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount if we find that the product has not been returned to us in fully resalable condition. Products which fall into the following categories will not be refunded unless they are proven to be faulty;
Any goods made to a customer's own specifications, made to measure or personalised items
Self assembly furniture cannot be returned once assembly is part or fully completed
This does not affect your statutory rights
RETURNS PROCEDURE FOR DAMAGED FURNITURE DELIVERIES
It is important to check the product for damages upon delivery. If you do find a fault or damage please sign for the goods as damaged or refuse the goods. If you sign for the goods with no comments, this means the goods have been received in satisfactory condition. It is very important to check the goods before signing for it. If there are any issues, please contact us immediately and ideally within 1-2 days of receiving the goods. Any issues reported after 2 days may not be accepted, however we would always do our best to help. In the unlikely event that your furniture arrives damaged or faulty please contact us within via email at sales@hartsfurniture.co.uk or call 0115 932 2374 immediately.
DATA PROTECTION
We reserve the right to keep all customer details on Harts ordering system and a paper copy of your details at our Head Office until such a time we deem it suitable to destroy them. We will take all reasonable steps to ensure all information remains confidential.
FURNITURE MEASUREMENTS
The dimensions given are written for your guidance. Before ordering, please ensure that there is adequate room to take the furniture through any doorways and windows, taking note of any restricted passageways, stairs and awkward turns. Please refer to our access guidelines for further information.
WARRANTIES
Our rattan garden furniture is made from synthetic all weather PE Rattan. When exposed to hot weather the rattan could naturally expand and contract and this would be perfectly normal. As the temperature cools down, the PE rattan will return to its original state. If this becomes a regular occurrence, we would strongly recommend covering the furniture to help protect it from the strong hot weather. Prolong exposure to hot weather could potentially damage the rattans structure and would shorten its life.
Our standard warranty lasts for 12 months unless stated otherwise. The warranty period starts from the date you receive your order. All warranties are provided by Harts Trading Ltd. If the problem is deemed by Harts Trading Ltd to be due to wear and tear or misuse rather than a manufacturing fault, then charges may be made for rectification.
Photographic proof of any faults must be emailed to Harts Trading Ltd for us to investigate the fault. No assistance can be offered unless we have details and photos of the manufacturers fault.
Harts Trading Ltd will not be able to accept responsibility or liability for products damaged in adverse weather conditions including windy weather, extreme hot weather etc.
We recommend all cushions to be stored indoors when not in use, especially in the autumn/winter period. Rain covers will help protect the cushion however they would not be able to stop the build up of condensation underneath the cover. Damage can occur if the cushions are left damp. Harts Trading Ltd will not accept any liability for cushions damaged due to not adhering to the above conditions.
No glass is covered under our warranty. If the glass is damaged upon arrival, please contact us within 24 hours for a replacement.
PAYMENT
All prices are inclusive of VAT (where applicable) at the current rates and are correct at the time of entering the information onto the system. The total cost of your order is the price of the products ordered plus delivery.

REFUSAL OF TRANSACTION
We reserve the right to withdraw any products from this Website at any time and/or remove or edit any materials or content on this Website. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion.
We will not be liable to you or any third party by reason of our withdrawing any product from this Website whether or not that product has been sold, removing or editing any materials or content on the Website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.
To be eligible to purchase products on this Website and lawfully enter into and form contracts on this Website under English law you must:
Register by providing your real name, phone number, email address, payment details and other requested information
Be over 18 years of age
Stipulate a delivery address in the United Kingdom. Please note that PO box numbers, hotels and accommodation addresses are not acceptable
Possess a valid credit or debit card issued by a bank acceptable to us
By making an offer to buy a product, you specifically authorise us to transmit information (including any updated information) or to obtain information about you from third parties from time to time, including but not limited to, your debit or credit card number or credit reports, to authenticate your identity, to validate your credit card, to obtain an initial credit card authorisation and to authorise individual purchase transactions.

In the event that you should need to make a complaint, please call our Customer Services Team on 0115 932 2374 and they will try their best to resolve the issue for you.
